JUDGEMENT

- (1.) Common questions of facts and law are raised in these four writ petitions. Having regard to the fact that interim order prayer and final order prayer being the same, they were heard on merits, and they are being disposed of by means of this common judgment.
(2.) The petitioners, K.V.R. Sarma, P.K.B. Rao, P.V.T.H. Murali Krishna and R.V.Sastry in the afore-mentioned writ petitions are the employees of UCO Bank in Southern Zone, of which Respondent No.1 is the Zonal Manager and Respondent No.2 is the Divisional Manager. The petitioners after having been transferred to certain places within the State of Andhra Pradesh in the Southern Zone, and while serving at particular places they were transferred by means of the impugned orders of transfer by the authorities to Madhya Pradesh. The common allegations made by the petitioners are that the impugned orders of transfer are in violation of the transfer policy under Circular No.CHO/POS/54/87 dated 27-10-87, whereby certain guidelines were formulated as agreed between the concerned Unions and the authorities of the Bank, classifying the type of officers, the method of posting them to different places by transfer, the meaning of transfer, the quotient to be evolved for the purpose of fixing the basis to transfer them from a particular place to another place or out of the State, other considerations like the difficult places, husband and wife working together, working in a particular place for a particular period etc., in addition to certain normal understanding of the matter, while deciding the matters relating to transfer to achieve the real purpose behind it. It is also generally alleged that such transfers are being effected without considering their representations, pending with the authorities or without giving them an opportunity to substantiate their representations, and in some cases the transfers are being made due to bias.;
