JUDGEMENT
A.Lakshmana Rao, J. -
(1.) In these writ appeals the validity of the judgment of the learned single Judge
dated February 21,1990 in Writ Petition No.3513 of 1989 to the extent it is against
each of the respective parties, is questioned. The appellants in Writ Appeal
No.480 of 1990 have filed the writ petition seeking appropriate Writ (1)
"declaring the action of the respondents in deducting the D.A. from th basic
pay drawn in the cadre of Wage Grade V and fixing the basic pay in the Pay
Scale I and II after deduction from the basic pay drawn in Wage Grade V is
illegal, unconstitutional and liable to be struck down; (2) issue a consequential
direction to re-fix the Basic Pay and Pay Scale of the petitioners in the Pay
Scale I and II from the date of their joining the said posts of P.S. I and II taking
into consideration the total basic pay drawn in Wage Grade V; and (3) further
directions to the respondents to pay the difference on the consequential re-
fixation to the petitioners." The learned single Judge allowed the Writ Petition
with the following directions:
"The respondents shall re-fix the total emoluments of the 38 amongst the
writ petitioners (referred to in para3(d)oftheadditional counter affidavit)
at one stage above what they had drawn in the lower cadre with effect from
the date of their promotion from W.G.-V to P.S.I/P.S. II, effect
consequential adjustments and pay them the entire arrears within three
months from the date of receipt of this order....."
(2.) The appellants in Writ Appeal No.413 of 1990 are the Chairman and
General Manager, Hindustan Machine Tools Limited (H.M.T. Limited),
Hyderabad and the appellants in Writ Appeal No.480 of 1990 numbering 149
are the employees of HMT Limited.
(3.) M/s. H.M.T. Limited is a Company incorporated under the Companies
Act. It is engaged in the business of manufacturing and sale of machine tools
and various other products. It has units established at Bangalore, Hyderabad,
Kashmir, Talamcherry (Kerala) and Pinjore (Punjab). It is stated that at
Hyderabad it has established six independent units manufacturing machine
tools, tractors, wrist watch cases, electric bulbs and tubes, etc. In the Machine
Tools Unit at Hyderabad, about 3,000 employees are stated to be on the rolls of
the Company. Out of them, 1,800 are workmen and 1,200 are of the officer cadre.;
