Gopal Rao Ekbote, J. - (1.) This is an application for the issue of a writ or order directing the respondents not to proceed further in pursuance of the search and seizure made by the 1st respondent, Deputy Superintendent of Police, in respect of the foodgrains found in the premises of Sri Ramanarayana Rice Mill on 27th October, 1968.
(2.) The material facts are that the petitioner is a dealer in foodgrains and holds a licence under the Foodgrains Dealers Licensing Order. His shop is situated at D.No. 2/130 Ba'zaar Street, Nagalapurarn. Under the licence, the petitioner was entitled to sell to a wholesaler as well as to consumers but not less than a bag of foodgrains.
(3.) On 27th October, 1968 the 1st respondent visited the business premises of the petitioner. He inspected the accounts. He found that the petitioner sold to consumers more than one quintal.;
