M SATYANARAYANA MURTHY,J. - (1.)This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in Crime No.392 of 2020 on the file of the Station House Officer, Jaggaiahpet Police Station, Jaggaiahpet, Krishna District, registered against the petitioner for the offences punishable under Section 34(A) of the Andhra Pradesh Excise Act, 1968 (for short "the Act").
(2.)Heard learned counsel for petitioner and learned Public Prosecutor appearing for respondent-State
(3.)The allegations, as per the Mediator's report, against the petitioner is that on 25.05.2020, the respondent-police, basing on the credible information received by them, went to Venkata Sai Food Plaza, SM Pet X road, Jaggaiahpeta, along with the mediators and started vehicle check. During the vehicle check, the petitioner attempted to flee away and return back in his BMW Car bearing No.AP 09 ED 0777, but on seeing the police, petitioner stopped the vehicle. The respondent-police inspected the petitioner's vehicle and found contra band in his possession and seized the same along with his vehicle under the cover of Mediators Report. Basing on the mediator's report, the respondent-police registered the above case against the petitioner.
