JUDGEMENT

- (1.)THIS appeal has been directed by the opposite party against order dated 29.9.2000 passed by Consumer Disputes Redressal Forum Gurgaon (hereinafter to be referred as District Consumer Forum), vide which the complaint of respondent Dalip Singh (complainant) was accepted and he was awarded compensation of Rs. 92,464 along with interest @ 12% p.a. which was to be calculated after three months of submitting the claim till payment.
(2.)BRIEFLY stated the facts are that the respondent Dalip Singh (complainant) was owner of bus bearing No. KL -IP -5101. It was insured with the appellant for the period 21.7.98 to 20.7.1999. It met with an accident on 12.5.99 during the continuation of insurance policy and the appellant was informed about the accident and it appointed surveyor to assess the loss. The surveyor asked the respondent to get the bus repaired and accordingly he got the bus repaired and spent more than Rs. two lakh over repairing, painting and purchase of spare parts and other components.
(3.)IT was next averred that respondent sent several letters for settling his claim but to no effect.
Alleging deficiency in service, the complaint was filed.
