JUDGEMENT

- (1.)THIS appeal has been directed by opposite parties against order dated 12.7.2000 passed by Consumer Disputes Redressal Forum, Jhajjar (hereinafter to be referred as District Consumer Forum), vide which the complaint of Basti Ram and Lehri Singh was accepted and appellants were directed to pay Rs. 7,000 to them for harassment, mental tension and loss suffered by them on account of fire due to negligence of the appellant department. Rs. 2,000 were further allowed to the complainants for deficiency in service by the appellants.
(2.)BRIEFLY stated the facts are that Sh. Munshi Ram, Junior Engineer - appellant No. 1 had purchased wheat from respondent Basti Ram (now deceased) and when he demanded price of the wheat, the Junior Engineer became annoyed and he made up his mind to teach him a lesson. To take revenge, the Junior Engineer erected an electric line on the main gate of the Gher of Basti Ram. Several requests were made to remove the line or to raise height of the line but of no use and as a result, trolly of unthrashed wheat caught fire causing loss of Rs. 7,000 to Basti Ram.
(3.)ALLEGING deficiency in service, complaint was filed.
Appellant contested the complaint and stated that Sh. Bali Ram, Junior Engineer (Construction) constructed the electric line in 1991 as per rules and the tubewell of Sh. Basti Ram was checked twice on 18.1.1992 and on 21.3.1992 and both times unauthorized load was found running and action was taken as per rules. They denied that the trolly of the complainant Basti Ram had caught fire due to their negligence.
