JUDGEMENT

H.S.THANGKHIEW,J. - (1.) The instant writ application is with regard to the claims by the petitioners who are stated to be the children of the deceased employee who had died on 15.03.1982, while serving as workcharged, Roller Driver in Public Works Department, for the release of their late father's Gratuity, Family pension and other debts and securities as admissible, and also for mandamus to appoint the petitioner No. 1 on compassionate ground.
(2.) Mr. M.F. Qureshi, learned counsel for the petitioners submits that the petitioners' father was initially appointed as a workcharged Roller Driver on 03.06.1966, and was transferred to Mairang Sub-Division on 03.02.1977, thereafter to Balat Sub-Division on 29.04.1978 and lastly to P.W.D. Sub-Division at Mawkyrwat on 05.07.1978. The learned counsel submits that after the death of the deceased employee, the mother of the petitioners approached the respondents for release of the benefits but, however, though there were directions to finalise the matter, the same did not yield any fruits and the said wife i.e. mother of the petitioners also expired on 20.12.1996.
(3.) The learned counsel submits that thereafter the petitioners were informed that the service record of their father was never traceable due to the destruction of the same in a fire accident. He further submits that the petitioners however had been assured that the case would be looked into, but have now been compelled to approach this Court as there was no relief forthcoming even after many long years. As such, he prays that directions be issued to the respondents for regularization of the service of their deceased father and for release of the service benefits as admissible.;
