JUDGEMENT

Mohammad Rafiq,CJ. - (1.) Two affidavits, one of the Deputy Director, Social Welfare Department, Government of Meghalaya, Shillong and another of the Joint Secretary, Health and Family Welfare Department, Government of Meghalaya, Shillong, have been filed responding to the suggestions given by learned Amicus Curiae, pursuant to the order dated 16.11.2019.
(2.) In the affidavit filed on behalf of Social Welfare Department, response has been given to various suggestions given by learned Amicus Curiae. It has been stated that on 05.11.2019 the Health Department has been requested to examine and take appropriate measures and prepare the Detail Project Report (DPR) for setting up of de-addiction centres and rehabilitation centres of the Government for children/adolescents. With regard to the de-addiction centres run by NGOs i.e. New Hope Centre, it is stated that the same is functioning properly. It is proposed to be shifted to newly constructed building at Mawkasiang. Another NGO run drug de-addiction centre viz, Kripa Foundation is also working properly. It is further stated that the Social Welfare Department has been working on the drug demand reduction by taking concrete steps to implement the State Demand Reduction Action Plan. It is also stated that that a proposal has been submitted to the Ministry of Social Justice and Empowerment to undertake focused intervention in vulnerable areas in collaboration with NGOs.
(3.) The affidavit filed on behalf of Social Welfare Department further stated that the proposals by NGOs i.e. (i) Kripa Foundation, Shillong; (ii) Manbha Foundation, Jowai and; (iii) Adil Gandhian Society, Tura have been submitted to the Ministry for Outreach and Drop In Centres (ODICs) and upon receipt of sanction from the Ministry, necessary establishments in various districts would be created to provide safe and secure drop-in-space for drug users. For the year 2019-2020, Mihmyntdu Community Social Welfare Association, Jowai has been identified for both Community Peer Led Intervention (CPI) and Outreach and Drop-in-Centre (ODIC).;
