(1.) Heard Mr. Chopde, learned counsel for the applicant and Mr. Wachasunder, learned counsel for the respondent.
(2.) This matter was admitted on 16.1.2008 and interim order was granted in favour of the applicant. This matter was not on board. However, when the connected matter bearing Criminal Application No.3376/2007 was called out, Mr. Chopde, learned counsel for the applicant submitted that since the issue in the present matter is identical, this matter may be disposed of. Mr. Wachasunder, learned counsel for the respondent has no objection for this course.
(3.) In Criminal Application No.3376/2006 which is disposed of by me today the parties are also the same. By reasoned order, I have dismissed the application filed by the applicants therein with liberty to approach the Sessions Court against the impugned order. For the same reasons, the application is dismissed with liberty to the applicant to file revision application before the appropriate Sessions Court against the impugned order dated 20.2.2007 passed by learned Magistrate within a period of eight weeks. In case the revision is filed before the Sessions Court within eight weeks, the Sessions Court shall condone the delay in filing revision application. For a period of eight weeks further proceedings before the learned Magistrate are stayed.
