(1.) At the out set it is required to be noted that since the allegations against the Applicant are in respect of the alleged sexual assault on the
Respondent- First Informant, the identity of both the Applicant as well as
Respondent- First Informant needs to be concealed, and in the title of this
order the Applicant is referred to as "ABC" and the Respondent- First Informant
is referred to as "XYZ". The Registry is directed to maintain the record
(2.) By way of filing present application under Section 482 of the Criminal Procedure Code, the Applicant prays for quashing of the FIR bearing
CR No.153 of 2018 registered with Sanpada Police Station against the
Applicant on 27/12/2018 for the offences punishable under Sections 376 , 323 ,
506 of the Indian Penal Code and under Sections 3, 4, 5 (L) and 6 of the POSCO Act and under Section 67 of the IT Act.
(3.) We have heard the learned counsel appearing for the Applicant and the Respondent i.e. First Informant. It is common contention of both of
them that the Applicant and the First Informant have amicably settled the
dispute and to that effect an affidavit is filed by the Respondent. It is
submitted that since the Respondent desires to proceed further in her life and
to make her career, pending proceedings arising out of CR No.153 of 2018
registered at Sanpada Police Station against the Applicant would be an
impediment and therefore, the said FIR as also the further proceedings arising
out of the said CR need to be quashed.;
