(3.) This criminal appeal has been filed against the judgment and order dated 26.01982 passed by learned IVth Additional Sessions Judge, Ghazipur, in Sessions Trial No. 125 of 1980, State Vs. Shyamraj and others, whereby the appellant Brijnath was convicted and sentenced under Section 304(Part II) I.P.C. with five years R.I. and the appellants Shyamraj and Shrinath alias Loha were convicted and sentenced under section 325 read with 34 I.P.C. with two years R.I.
