JUDGEMENT

(1.) Heard Mr. N.K. Dwivedi, learned counsel for the petitioner, and learned Standing Counsel for the State.

(2.) By means of the present writ petition filed under Article 226 of the Constitution of India the petitioner has prayed to issue a writ, order or direction in the nature of mandamus commanding the opposite parties to make notional promotion of the petitioner on the post of Assistant District Cooperative Officer Grade-1 and to pay him the arrears of salary and increments with effect from 04.05.2010 after completion of 26 years' of service.

Learned counsel for the petitioner has submitted that the petitioner initially joined on the post of Cooperative Farming Supervisor on 20.05.1974 and on 15.09.1987, he was promoted on the post of Assistant Development Officer (Cooperative) whereas his junior Shiv Saran Maurya was promoted on the post of Assistant Development Officer (Cooperative) Group-II on 28.05.1985. Thus, the petitioner has claimed parity and has made a prayer for promotion from the date his junior Shiv Saran Maurya was promoted.
