JUDGEMENT

(1.) Heard Sri Pawan Kumar Patel, learned counsel for the petitioner, Sri D.N. Yadav, learned counsel appearing for the respondents no.5 to 15, Sri Ram Babu Yadav, learned counsel for the respondent no.16 and Sri S.K. Upadhayay, learned Standing Counsel for the respondents no.1 to 4.

(2.) This petition has been filed on the allegations that the respondents no.5 to 15 have made illegal construction over plot no.73 situated in Village-Parhi Nagar, Pargana-Aharaura, Tehsil-Robertsganj, District-Sonbhadra, which is reserved for plantation/greenery.

(3.) On 2.2.2017, this Court had directed the Respondents no.3 and 4, Sub-Divisional Magistrate, Tehsil-Robertsganj, District-Sonbhadra and Tehsildar Robertsganj, District-Sonbhadra respectively to file their personal affidavits by way of counter affidavits.
