JUDGEMENT

SUNITA AGARWAL,J. - (1.)To put the record straight, it is noted here that Sri Ram Niwas Singh Advocate who has put in appearance on behalf of respondent nos. 3/1 and 3/4, filed a counter affidavit in a substitution application numbered as "178827 of 2015" in the Registry on 26.3.2017, after the judgment was reserved. By means of the said affidavit, he seeks to submit that in the description of heirs of Bali Raj i.e. respondent no. 3, name of respondent no. 3/4 namely Hari Lal in the aforesaid application is incorrect whose correct name is Hari Shankar.
(2.)The substitution application has already been allowed on 20th March, 2017 after hearing Sri Ram Niwas Singh, learned Advocate as such no order can be passed on the basis of averments in the counter affidavit.
(3.)Heard Sri V.K. Singh, learned counsel for the petitioners, Sri Rajesh Kushwaha for respondent nos. 3/2 and 3/3, Sri Ram Niwas Singh, learned counsel for respondent nos. 3/1 and 3/4.
