JUDGEMENT

(1.) Heard learned counsel for the petitioner, learned Standing Counsel and Sri Sanjeev Kumar Singh, learned counsel for respondent no. 5.

(2.) The petitioner is one of the members of the Gram Panchayat, he raises a dispute with regard to nomination of respondent no. 5 to officiate as Gram Pradhan on account of casual vacancy arose on 4.12016 due to death of the elected Gram Pradhan.

(3.) Placing reliance upon the Division Bench judgment of this Court in Udaivir Vs. State Election Commission of U.P. through its Chairman and others reported in 2009 (106) RD 151, it is submitted that the District Magistrate was under obligation to convene a meeting of the elected members of the Gram Panchayat so as to ascertain their wishes before nomination of the officiating Pradhan under Sec. 127 of the Panchayat Raj Act, 1947.
