(1.) Heard Mr. Hemant Kumar Mishra, learned counsel for the petitioner as well as learned Standing Counsel.
(2.) In order to verify the entries awarded to the petitioner, I summoned the relevant record of office, upon perusal of which I find that in 2003-2004, he was awarded one adverse entry for the reason that he could not achieve the target of realization.
(3.) The controversy as to whether for this reason the employee can be awarded the adverse entry or not has been settled by this Court in the case of Jagannath Prasad Shukla v. The State of U.P. and others in writ petition No. 5615 (SS) of 2002. In that case also the petitioner was awarded the adverse entry in one year only on the ground that he could not achieve the target of realization. This Court examined the matter and quashed the order impugned.
