(1.) THE appellant was having electric connection bearing account No. MP -26/208. The respondent had claimed Rs. 22,691 was sundry charges in the bill dated 20.1.2003. This bill was challenged by the appellant in District Consumer Disputes Redressal Forum, Ludhiana (in short the District Forum ) and the said complaint was decided vide order dated 5.11.2003.
(2.) IT was further pleaded that another amount of Rs. 15,056 was charged for electric connection bearing account No. MP -26/304 CS. On 13.11.2003, the officials of the respondents visited the premises of the appellant and prepared a false report that there was inter -mixing of electricity load. The respondents issued the bill dated 19.11.2003 for Rs. 1,24,408 and disconnected the domestic connection of the appellant without giving any notice to him and without giving any opportunity of being heard. The respondents were requested to withdraw the demand and to restore the electric connection but to no effect.
(3.) IT was further pleaded that the respondents issued the demand memo dated 19.11.2003 for Rs. 7,809 against electric connection bearing account No. ME -01 -0038 MS. The appellant deposited the amount under protest only to get restored the supply of electricity of account No. ME -01/0038 MS. Alleging deficiency in service on the part of respondents, the appellant filed a complaint against them for quashing the demand of Rs. 1,24,408 and for the refund of amount deposited. Compensation, interest and costs were also prayed.
The respondents filed the written statement. It was pleaded that the electric connection bearing account No. MP -26/208 of domestic category was checked by the Senior Executive Engineer -I, Enforcement Squad -4 on 13.11.2003 in the presence of the appellant. The checking report was signed by the appellant. It was reported by the checking party that the electric connection bearing account No. MP -26/208 meant for domestic purpose was being used for commercial purpose i.e. for running a hosiery in a three storey building. The consumer was using 46.062KW load against the sanctioned load of 21.96KW and it was excess by 25.102 KW.;
