JUDGEMENT

- (1.) APPELLANT -Risiga Agro (India) Pvt.Ltd. has filed this appeal against the impugned order dated 7.4.2004 passed by the District Consumer Disputes Redressal Forum, Muktsar (in short, 'the District Forum').
(2.) THE facts as are made out from the complaint filed by respondent No. 1/ complainant (hereinafter called 'the complainant') are that respondent No. 2/ opposite party No. 1(herein after called 'respondent No. 2') is a firm dealing with the business of selling insecticide, pesticides, seeds etc. and in the month of February 2003, the complainant has sown Chilly paniri of hybrid quality MS -12LLS in 2 Kanals of land which was purchased from Sohi Mirch Farm, Dhuri for Rs. 3,000.
(3.) IN the month of August 2003, insects/sundi attacked the crop when the height of the plants was 3 -31/2 ft. and in order to destroy the insects / sundi and for the protection of his crop, complainant went to the shop of respondent No. 2 for purchasing insecticide on 8.8.2003 i.e. Trump 2 Litres for Rs. 520, Lazar 3 Litres for Rs.690, Fire 1 Litre for Rs. 230 and King(Quinalthoa 25% EC) 2 Litres for Rs. 480. Respondent No. 2 recommended that Trump, Lazar and Fire is used for cotton crop and insecticide King for chilly crop for destroying the sundi/insects and issued a bill No. 177 for Rs. 1,920. Complainant purchased these insecticides through his Commission Agent M/s. Resham Lal Anil Kumar, which is the sister concern of respondent No. 2.;
