(1.) THE appellant was having telephone (sic. electricity)connection bearing account No. SP 11/0372 for running his flour mill. On 10.2.2003, the employees of the respondents replaced the old electric meter with new electric meter. The new electric meter was running fast on which the appellant filed an application dated 28.8.2003 to the respondents for checking the electric meter. On his application, the S.D.O. Doraha marked the enquiry to the concerned J.E. who reported that the electric meter was running in double speed. The appellant deposited the amount of the electric bills as under: Date of the Bill Amount deposited by complainant 14.3.2003 Rs. 7,750 16.4.2003 Rs. 6959 15.5.2003 Rs. 7,145 14.6.2003 Rs. 6,340 16.7.2003 Rs. 6,800 14.8.2003 Rs. 6,485
(2.) IN all, the appellant deposited an amount of Rs. 52,095.
(3.) IT was further pleaded that the appellant requested the respondents to refund the excess amount or adjust the excess amount of Rs. 52,095. Alleging deficiency in service on the part of the appellant, the appellant filed a complaint against the respondents in the learned District Consumer Disputes Redressal Forum, Ludhiana (in short the District Forum ) for refund of the amount of Rs. 52,095 with interest. Compensation and costs were also prayed.
The respondents filed the written reply. It was pleaded that the appellant was subscriber of Small Power Industrial Connection having sanctioned load of 19.94 KW with which he was running the flour mill. Therefore, he was not a consumer. It was admitted that the electric meter of the appellant was changed on 28.11.2003. Prior to that, he was making the payment of electricity bills upto August, 2003 without raising any objection because the electric meter was running at a proper speed.;
