(1.) HEARD the arguments of the learned counsel for the parties and perused the records.
(2.) THE writ petition is filed by three workmen against a common order, dated 28 July 1997, passed by the first respondent Labour Court in C.P. No. 1417 of 1992. The petitioners were working in the second respondent factory. The three petitioners along with 88 other workmen filed a petition before the first respondent Labour Court under S.33C(2) of the Industrial Disputes Act (for short, I.D. Act) claiming wages for the lock -out period from February 1991 to March 1991. The petitioners are serial Nos. 38, 42 and 83 before the Labour Court. The other workers have not come forward to challenge the said order.
(3.) THEREAFTER , a writ appeal being Writ Appeal No.101 of 1991 was filed by the union in which in Para.3, it was observed by the Division Bench as follows :
