JUDGEMENT

- (1.) Offences under Sections 447 end 379 I.P.C. are distinct from the offence under Section 188 I.P.C. Section 195 Code of Criminal Procedure, does not bar the trial of an accused for a distinct offence by the same or on slightly different set of facts and which is not included within the ambit of the section-Vide Durgacharan Naik v. State of Orissa (1) and Chandrika Rao and Hazari Lal v. State of Bihar (2). The order of discharge is set aside and the case shall be disposed of according to law by the other Magistrate nominated by the District Magistrate. The revision is allowed.;
