JUDGEMENT

ABHILASHA KUMARI, J. - (1.) LEAVE to amend the nomenclature of respondent No.1 and to add the Registrar of Births and Deaths, is granted. The necessary amendment be carried out, forthwith. Ms. Shruti Pathak, learned Assistant Government Pleader, submits that she would be appearing for the Registrar of Births and Deaths as well as the State of Gujarat.
(2.) RULE . Ms. Shruti Pathak, learned Assistant Government Pleader waives service of notices of Rule for respondents Nos.1 and 3. Respondent No.2TalaticumMantri, Maknaj Gram Panchayat, District Mehsana, has been served but has not cared to put in an appearance before this Court, till date. As it appears that the said respondent is not interested in contesting the petition, there is no requirement of issuing notice of Rule to him.
(3.) ON the facts and in the circumstances of the case and with the consent of the learned counsel for the respective parties, the petition is being heard and decided finally. By preferring this petition under Article 226 of the Constitution of India, the petitioner has prayed for the issuance of a writ of mandamus or any other appropriate writ, order or direction to the respondentauthorities to correct the date of birth of the petitioner in the Birth Certificate.;
