MANKAD, J. -
(1.) The Tribunal has acted in excess of its jurisdiction in giving the directions to the effect that no note of misconduct shall be kept or that if such note is kept it shall be removed and that misconduct shall not be treated as "past misconduct". We do not find any provision of law under which the Tribunal had power to give such directions. The domestic inquiry in each case is held to be legal and proper and the penalty imposed is also not held to be excessive, harsh or out of proportion. In none of the cases before us, the Tribunal considered it necessary or proper to interfere with the penalty imposed by the petitioner Corporation. If misconduct is committed and proved, it must be reflected in the service record of the employee which the petitioner Corporation is required to maintain under Regulation 43-C of the Regulations.
Rule made absolute. ;
