JUDGEMENT

- (1.) Mr. Vyas then alternatively urged that the order granting the land being made under Section 37(1) of the Land Revenue Code, the Deputy Collector was exercising the power of the Collector and therefore it should be deemed to have been delegated power and so, the Deputy Collector should be held to have acted as a Collector and therefore Collector could not revise the Collector's order. These arguments are negatived by the judgment of Justice B. J. Diwan, as he then was, in the case of Patel Khodidas Gangaram Ramchand v. S. K. Chaudhri and Others, 13 GLR 1029. It has been held that a Deputy Collector and an Assistant Collector exercising powers of the Collector exercise those powers as subordinate officers and not as delegates of the Collector. Appeals dismissed. ;
