JUDGEMENT
RAVI R.TRIPATHI, J. -
(1.)THE present Letters Patent Appeal is filed aggrieved by judgment and order passed by the learned Single Judge
in Special Civil Application No.12595 of 2012 dated
17.9.2012; whereby, learned Judge was pleased to dismiss the petition.
(2.)LEARNED advocate, Mr.Kirtidev R.Dave, for the appellant submitted that the appellant had obtained
license in the year 2004 which was renewed in the year
2007. It is, thereafter, that the criminal case was filed against him arising from FIR C.R.No.I-41 of 2008 but in
that case, he was acquitted by judgment and order dated
20.11.2010. Thereafter, he filed application for renewal of license in the year 2011 and that application is not
granted and the same is rejected by Sub-Divisional
Magistrate (S.D.M.) and also Appeal filed before the
District Magistrate (D.M.) is rejected and thereafter, he
approached this Court by filing special civil application.
On perusal of papers, i.e. the order passed by the District Magistrate, a copy of which is produced at
Annexure-D, translation is at page No.16-A to 16-C,
reveals that the learned advocate is not aware about
filing of 3 more cases against the petitioner bearing
C.R.No.I-4 of 2009, C.R.No.I-40 of 2010 and C.R.No.I- 32
of 2010. These are the cases filed for offences under
Sections 379, 511 and 120-B of Indian Penal Code and also
Sections 3 and 7 of Damages of Public Property registered
at Vasad Police Station and Aslali Police Station.
(3.)LEARNED advocate for the petitioner states that he does not know as to what happened to those cases.
