JUDGEMENT

(1.)AS common question on law and facts are involved in this group of petitions they are disposed of by this common judgment.
(2.)IN this group of petitions, the petitioners have prayed to quash and set aside the order dated 28.11.2006 passed by the learned Joint District Judge, Panchmahals,Godhra in Misc. Civil Appeal Nos. 61/2006, 64/2006, 62/2006, 63/2006 and 65/2006, whereby the status-quo as prayed for was granted till the final disposal of the suit.
Heard learned counsel for the respective parties and perused the documents on record. It appears that the status-quo granted by the lower appellate Court in the year 2006 has not been modified till date. Therefore, it will not be proper to disturb the same at this stage. Considering the facts of the case and since the main Suits are pending adjudication before the trial Court, it would be appropriate that the same are disposed of as expeditiously since any observations that may be made by this Court on the merits of the present case may prejudicially affect the rights/ interests of either party in the proceedings pending before the trail Court concerned.
In view of the above, the trial Court concerned is directed to disposed of the Suits in question expeditiously since the same are on the final hearing stage. However, if an application is preferred by the petitioners for expeditious hearing of the Suits, the trial Court concerned is directed to expedite the Suits and dispose of the same within a period of three months from the date of receipt of such application. Both the sides shall co-operate in the proceedings before the trial Court concerned so that the Suits are disposed of expeditiously. It is observed that this Court has not entered into the merits of the case and therefore, the trial Court concerned shall decide the Suits on its own merits and without being influenced by the observations made by it in its earlier order.
(3.)WITH the above observations and directions, the petitions stand disposed of. No order as to costs.
