JUDGEMENT

NAVANITI PRASAD SINGH,J. - (1.) This intra court appeal is from the judgment of a learned single Judge of this Court dated 31.08.2017 passed in W.P.(C) No. 23657 of 2017, whereby the writ petition filed by the writ petitioner/appellant was dismissed and interim orders were vacated.
(2.) We heard the matter earlier and pointed out that the writ petitioner, not having challenged the conditions contained in the prospectus, by virtue of which he was being denied admission, could not succeed. We also pointed out that the person, who had been admitted in the writ petitioner's place consequent to the interim orders being vacated, having not been impleaded as a party, we could not grant any relief even at the appellate stage. The case was adjourned for learned counsel to consider these impediments.
(3.) The appellant thereafter filed I.A. No. 1144 of 2017 to amend the writ petition in the appeal wherein, certain additional facts were sought to be brought on record. In the relief sought, the relevant provision of the prospectus was now challenged.;
