JUDGEMENT

- (1.) This application is for suspension of sentence and grant of interim bail under Section 389 Cr.P.C moved on behalf of the appellant who was convicted by the trial court under Sections 420/468/471/120B of Indian Penal Code.
(2.) The allegations against the appellant were that he entered into a conspiracy with certain officials of Riots Relief Cell-I, D.C Office, Delhi with the object to cheat the office of Deputy Commissioner, Delhi and in pursuance of the said conspiracy got revalidated six cheques for the amounts of Rs.70,000/- issued by the Pay and Accounts Officer. In pursuance of this conspiracy he got opened three fictitious accounts in the State Bank of India, Gazipur Branch in the joint names of the beneficiaries and thereafter got deposited the aforesaid six cheques in the said accounts and then withdrew the amounts from the above said fictitious accounts.
(3.) The conspiracy, forgery and all other ingredients of the offence charged against the appellant were proved by documentary as well as oral testimony. Suspension of the sentence of the appellant is sought on the ground of illness of the appellant. The medical record of the appellant has been perused by me which reveals that the appellant is a patient of Parkinson disease and his present condition is not good.;
