JUDGEMENT

- (1.) This appeal is directed against the order dated 16th July, 2007 passed by the learned Single Judge dismissing the writ petition filed by the petitioner herein after recording findings that the appellant is not operating even at the existing tehbazari site allotted and is not a person who is desperately in need of tehbazari site.
(2.) We have heard the learned counsel for the appellant who has challenged the findings recorded by the learned Single Judge. We have also heard the learned counsel for the respondent and have perused the records.
(3.) Learned counsel for the appellant has submitted that some other persons have been granted tehbazari rights at Sarojini Nagar, but the request of the appellant that the tehbazari right granted to him may be shifted from Basurkar Market, Moti Nagar to Sarojini Nagar has been denied. It is stated that the case of the appellant stands on a better footing and the appellant has been discriminated.;
