(1.) The petitioner has filed the present petition under Section 276 of the Indian
Succession Act, 1925 for grant of the probate of the last Will and testament of
his father Sh. Raj Kumar Kapoor dated 17.03.1995. Respondent nos 2 and 3 are
the brothers of the petitioner.
(2.) Smt. Kamla Kapoor is stated to have been residing at 15/2, Sarvpriya Vihar,
New Delhi-16 and passed away on 29.7.2005 leaving behind three legal heirs being
the petitioner and respondent nos.2 and 3. Smt Kamla Kapoor is stated to have
been the owner of half share in property bearing no.CF-14 (A-2224) Sector A,
Greenfield Residential Colony, Faridabad, Haryana measuring 214 square yards in
pursuance a registered sale deed duly registered on 07.06.1990. Smt Kamla
Kapoor is stated to have executed her last will and testament dated 17.03.1995
bequeathing all her rights, title and interest in the various properties as per
the Will. The property at Faridabad has been bequeathed to the petitioner
while the property at 15/2 Sarvpriya Vihar, New Delhi is to devolve on
respondent nos 2 and 3. Husband of the petitioner Sh. Devender Singh has been
appointed as the executor of the Will.
(3.) There has been no opposition by anyone to the grant of the probate of the Will
including respondent nos 2 and 3.;
