JUDGEMENT
C.HARI SHANKAR, J. -
(1.) These are familial disputes between the step-mother on the one hand and her husband and step-daughter on the other. Allegations have been raised by each of them against the other, resulting in cross FIRs being filed on the same date, i.e. 9th June, 2021.
(2.) The filing of these FIRs resulted in the premises of the parties being visited by the police authorities, who, in the rukka, have also stated that they found injuries on the persons of both parties.
(3.) Happily, however, thereafter the disputes between the parties appear to have been satisfactorily resolved with the intervention of the Delhi Government Mediation and Conciliation Centre. The terms of the settlement have also been placed on record and are reproduced, for ready reference:
"During the course of Mediation, the parties were heard at length and various proposals were generated during the course of mediation. Negotiations were held between the parties jointly and separately. The matter has been settled between the parties voluntarily, amicably and without any coercion or pressure, on following terms:-
1. Both the parties have agreed to bury their earlier differences for all the time to come and promise to each other to live a decent, peaceful happy marital life in the company of each other.
2. It is agreed that both the parties i.e. Dr. B. Ramaswamy and Ms. Sasikala Pushpa shall join the company of each other on or before 20.06.2021 at 135 North Avenue, New Delhi -110001 alongwith the female child Ms. Anjali as mentioned herein above, and shall continue to live together in the matrimonial house.
3. It is agreed that both the parties shall give due regard / respect in future and extend their love and affection to each other as well as the aforesaid female child Ms. Anjali.
4. That Dr. B. Ramaswamy and his wife Ms. Sasikala Pushpa both of them accept their all responsibilities in respect of the female child Ms. Anjali as mentioned above and undertake to take care of each other as well as the above said female child with core of their heart.
5. That the parents, relatives and family friends, etc. of both the parties will not interfere in any manner which may adversely affect their matrimonial life.
6. It is agreed between the parties that both will not quarrel with each other or use any unparliamentary language and maintain cordial atmosphere in the interest of the family welfare. In case of any difference of views, both the parties would resolve the same amicably between themselves in the first instance.
7. That both the parties hereby understand and acknowledge the welfare of the female child namely Ms. Anjali and assure each other for betterment of their future wellbeing to live in peace and tranquillity assure that the above female child lives peacefully without any mental or emotional stress, strain and anxiety or depression.
8. It is further agreed between the parties that both the parties shall approach the Hon'ble High Court of Delhi at New Delhi for quashing of the aforesaid FIRs No.50/2021 u/s 325/323 IPC 12 POCSO and 75 JJ Act PS North Avenue, New Delhi, filed by Dr. B. Ramaswamy against Ms. Sasikala Pushpa AND FIR No.49/2021 u/s 354/323/34 IPC PS North Avenue, New Delhi, filed by Ms. Sasikala Pushpa against Dr. B. Ramaswamy in terms of this settlement.
9. That the settlement has been arrived between the parties voluntarily and both the parties agree to remain bound on this settlement.
