JUDGEMENT

- (1.) THE applicants have preferred this application under Section 439 of the Cr.P.C. for grant of bail. They are accused in Crime No.198/2004 registered at Police Station Somani, Dist-Rajnandgaon (Chhattisgarh) for commission of offence punishable under Sections 4, 5, 6 of the Immoral Traffic (Prevention) Act. 1956. Both the counsels for the applicants and learned Panel lawyer for the State submit that both the cases are arising out of same crime, therefore, they pray that these cases be heard analogously. Considered. Prayer allowed. Heard.
(2.) ALLEGATION against the applicants is that on 04-09-2004, on information, Police party made a raid in Green Land Hotel, Somani. Surendran Pillai. Present applicant is the manager of this hotel. Other applicant Rajesh Verma was found in one of the rooms of that hotel with one woman namely Surekha, who at that time was in underwear. Contention of the applicants is that they are innocent, they are not involved in the alleged offence. They have falsely been implicated in this case. Taking into consideration all the facts, both the petitions are allowed and it is directed that on furnishing a personal bond of Rs. 10,000/- (Rupees ten thousand) with two sureties in the like sum by each of the applicant to the satisfaction of the concerned Court for their appearance before the concerned Courts as and when so directed, they be released on bail. Bail Granted.;
