(1.) HEARD .
This is a habeas corpus petition filed by Ram Ratan. He has alleged in
the petition that his daughter Ku. Suranjana left the house on 15-03-2005 at
6.00 A.M. to appear for 10th Board Examination. But she neither reached the examination centre (Government JMP School, Takhatpur) nor she
returened home. On 18-03-2005 he came to learn that she has been forcibly
abducted by respondents 7 and 8 while she was on her way to examination
centre. The petitioner has made a prayer for directing respondents 5 to 9 to
produce Ku. Suranjana in this Court and to set her at liberty.
Pursuant to order passed by this Court, respondents 8 and 9 have
appeared but respondent No.7 did not appear and on 13-7-2005 the Court
directed that a warrant of arrest be issued to respondent No.Tand warrant be
executed by the Station House Officer, Takhatpur, District Bilaspur and
respondent No.7 shall be produced before, this Court today Pursuant to the
said order, a warrant of arrest was issued and the. respondent No. 7 was arrested
and produced before this Court to day. The girl Suranjana has also been
recovered and given in custody the petitioner i.e. Ram Ratan.
Or a query by the Court as with whom the girl would like to stay
Suranjana stated before the Court that she would like to stay with her parents
namely the petitioner Ram Ratan and her mother. Suranjana may therefore,
stay with her parents as per her wish.
Regarding respondent No.7, it will be open for the police to take such
action as is warranted by law against him, if according to the police, he has
committed any offence.
With the aforesaid directions the writ petition stands disposed of.
Custody of the girl given to parents.;
