(1.) HEARD on M. (Cri). P.No. 3049/2004 for suspension of contence and
grant of bail to the appellant.
At the very outset, counsel for the appellant submitted that he wants to
withdraw the application for grant of bail so far as appellant No. 1 Ganga
Ram. No.2 Pade alias Manglu alias Laxman, appellant No. 3 Bhagwan Das
and appellant No.4 Santosh alias Thono.
So far as the bail application for appellants No. 1 to 4 is concered, the
same is disposed of as withdrawn.
On the last date of hearing, counsel for appellant submitted that the
case of appellant No.5 is similar to that co-accused Sudarshan, Parganiha,
Ugrasen, Dhaneshar and Suklal who have been granted bail in Cr.A. No.
837/2004 vide order dated 31-3-2005. He claimed parity. State Counsel was given opportunity to go through the record.
Shri Bhatia submits that he does not dispute it.
Accordingly, the bail application of appellant No.5 Mukund is allowed.
It is directed that the execution of jail sentence awarded to the appellant
No.5 Mukund shall remain suspended and he be released on bail on his
furnishing a personal bond in the sum of Rs. 5,000/- with two sureties of the
like amount to the satisfaction of the trial court for his appearance before the
Registry of this Court on 26-9-2005 and on such other dates as may be fixed
by the office. The bond shall contain photograph, crime number and the
details of the immovable and moveable properties of the appellant. Before
accepting the bond, copy of the same shall be handed over to the prosecution.
Accordingly, M.(Cri.). P.No. 3049/2004 stands disposed of.
