JUDGEMENT

K.H.N.Kuranga, C.J. - (1.)Heard Shri. G.S. Ahluwalia counsel for the applicant and Shri Gautam Bhaduri, Govt. Advocate, for the State/Non-Applicant.
(2.)This petition under Section 439 of the Code of Criminal Procedure has been filed by applicant Samaru Das Mohant for grant of bail. He is one of the accused in Crime No. 08 of 2003 registered in Champa Police Station for the offences punishable under Sections 307, 450, 323 read with Section 148 of the Indian Penal Code. It is submitted that there are four accused persons in the said case including the applicant.
(3.)Name of complainant is Phiratram. The incident took place on 18/01/2003. The case of the prosecution is that the applicant and his brother Phool Das went to the house of the complainant, dragged him out and thereafter Phool Das stabbed him with a knife.
