JUDGEMENT

V.D.Tulzapurkar, J. - (1.) Leave granted.
(2.) After hearing counsel for both sides we are satisfied that the delay in filing the appeal before the High Court should be condoned. It is clear that for mistake of the advocate and or his clerk it would not be proper to penalise the party. In the peculiar facts and circumstances of the case, therefore, we condone the dealy and direct that the appeal be heard on merits. The impugned order is set aside. The High Court may' dispose of the appeal on merits as expeditiously as possible preferably withih six months.;
